Terms of Engagement

These Terms of Engagement ("Terms") govern your use of the ONYX Property | Concierge | Security website ("Site") and the provision of services by ONYX ("ONYX", "we", "us"). By browsing the Site or making an enquiry, you agree to these Terms.

ONYX operates in Auckland, New Zealand. These Terms are governed by the laws of New Zealand and any dispute is subject to the exclusive jurisdiction of the New Zealand courts.

The Site is provided for general information only. Content does not constitute legal, financial, immigration, security or investment advice and should not be relied on as such. You must not use the Site for any unlawful purpose, attempt to interfere with its operation, or scrape, copy or redistribute its content without our prior written consent.

Submitting an enquiry through the Site does not create a client relationship or any obligation on ONYX to provide services. All engagements are accepted at our sole discretion and are formalised through a separate written services agreement that sets out scope, fees, term and confidentiality.

ONYX works with a limited number of clients to maintain the standard of service. We reserve the right to decline an enquiry without giving reasons.

Discretion is fundamental to our work. Information shared with ONYX in the course of an enquiry or engagement is held in strict confidence and disclosed only to personnel and suppliers who need it to perform the service, or where disclosure is required by law.

Where ONYX coordinates third-party providers (e.g. legal advisers, immigration counsel, contractors, security personnel, lifestyle vendors), those providers contract with the client directly or are engaged on the client's behalf under a separate agreement. ONYX is not liable for the acts or omissions of independent third parties.

Fees, retainers and disbursements are set out in the written services agreement for each engagement. Quotes provided prior to engagement are indicative and subject to scope confirmation.

All content on the Site - including text, imagery, logos and the ONYX name - is owned by or licensed to ONYX and is protected by New Zealand and international intellectual property laws. No licence is granted to reproduce or use this content other than as expressly permitted.

To the maximum extent permitted by law, ONYX is not liable for any indirect, consequential or incidental loss arising from your use of the Site or from services provided, and our total liability under any engagement is limited to the fees paid by the client to ONYX for the specific service giving rise to the claim. Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where they apply.

We may update these Terms from time to time. The version published on the Site at the time you interact with us applies.
